Free choice of the professional and sectorization Article 6 of the Law on the health services and the social services stipulates that “Any person has the right to choose the establishment of which it wishes to receive services”

Your rights are as follows:

If you were never followed in psychiatry or if you had a follow-up and that your file has been closed for more than 6 months:

• You can have access to the hospital complex of your choice;
• You have only to make a request for follow-up to the establishment which you choose.

If you are refused the free choice of the establishment or if one makes pressures to make you change opinion, you are not respected in your rights.

It is illegal to oblige a person to sign an access authorization to its file to decide if she can have or not access to services. These new rules force the people to give access to their file, therefore to reveal personal and confidential information. The file of a user is confidential. When a person gives access to her file, it must be able to give a free and enlightened assent. The new rules do not ensure in only the free choice of the establishment will be complied with. The people are likely to remain “attached” to their hospital.
